Terms and Conditions

The terms that apply when you book and take a ride with Limpopo Ride — bookings, fares, cancellations, conduct, and liability.

1. Scope and Acceptance

These Terms and Conditions (“Terms”) govern your access to and use of the Limpopo Ride website and the Limpopo Ride mobile application(s), including the Rider App and the Driver App (together, the “App”), and the car hire and chauffeur services booked through them (the “Service”). By creating an account, making a booking, or otherwise using the Service, you agree to be bound by these Terms.

If you are booking on behalf of a company or under a corporate account, these Terms apply to that booking together with any separate corporate agreement in place, which will take precedence over these Terms in the event of a conflict.

These Terms are separate from, and should be read alongside, our Privacy Policy, which explains how we handle personal data.


2. Who We Are

3. Some Definitions

  • “User” means anyone with a Limpopo Ride account, whether they are the rider or booking on behalf of a guest.
  • “Guest” means the person actually being transported, where different from the User who made the booking.
  • “Driver-Partner” means a professional driver who has completed Limpopo Ride’s onboarding and orientation process and provides rides through the App.
  • “Booking Confirmation” means the email, SMS, or in-app notification confirming that a ride request has been accepted.

4. Eligibility and Account Registration

You must be at least 18 years old to create an account or book a ride. By registering, you confirm that all information you provide, or that is provided on your behalf, is complete and accurate, and you agree to keep it up to date. Registrations made through automated means (bots, scripts) are not permitted.

You are responsible for keeping your account credentials confidential and for all activity under your account. Tell us immediately at info@limpoporide.com if you believe your account has been accessed without authorisation.


5. How a Booking Becomes a Contract

Submitting a ride request through the App or website is an offer to book the Service, not a confirmed booking. We will acknowledge receipt of your request, but a contract for that specific ride is only formed once we send you a Booking Confirmation. Once confirmed, you are entitled to the ride service described in that confirmation.


6. Ride Types

Subject to availability in your area, the App may offer:

6.1 Point-to-Point / Transfer Rides. A ride from a specified pickup location to a specified destination, priced according to the route and vehicle class shown at the time of booking.

6.2 Hourly Hire. A booking for a set number of hours (including standard, 12-hour, and 24-hour packages, where offered), beginning at the confirmed pickup time. If you ask your Driver-Partner to travel outside our standard service corridors, or you exceed the booked hours, additional charges may apply as described in Section 9.

6.3 Airport Pickup and Drop-off. Airport rides are priced to include applicable tolls and parking, as shown at the time of booking. Where we or a Driver-Partner provide a pickup or drop-off at an airport, that part of the ride is also subject to the rules of the relevant airport operator, including the Federal Airports Authority of Nigeria (FAAN), and we may need to adjust pickup arrangements to comply with them.


7. Vehicle Classes

Depending on availability, you can choose from vehicle classes shown in the App (for example, Standard, Premium, and VIP). Vehicles shown in the App are illustrative examples of the class, not a guarantee of a specific make or model; the actual vehicle provided will meet the standard of the booked class but may vary. We may, at our discretion and at no extra cost to you, provide a higher class vehicle than booked, depending on availability.


8. Pickup Time, Flight Tracking, and Delays

The agreed pickup time is the time stated in your Booking Confirmation. Where you have provided an accurate flight number for an airport pickup, we will track the flight and adjust the pickup time to reflect the actual arrival time where reasonably possible.

Delays caused by circumstances outside our reasonable control, such as traffic incidents, road closures, or severe weather, may affect pickup and journey times. We and our Driver-Partners will make reasonable efforts to keep you informed, but we are not liable for delays caused by such circumstances.


9. Ride Changes and Extensions

You may ask to change a ride after booking, or after it has started, subject to what is reasonably possible for the Driver-Partner to accommodate. If a change increases the distance travelled or the time required (for example, extending an hourly hire, adding stops, or extending the route beyond our standard corridors), the additional service will be charged according to the applicable rates shown in the App at the time. If a booked ride is shortened, the originally agreed price is not reduced.


10. Luggage, Pets, and Special Requests

The price shown at booking includes the standard luggage allowance for the vehicle class booked. Excess or bulky luggage, mobility equipment, or pets must be flagged at the time of booking. A Driver-Partner may decline to carry luggage, equipment, or pets that were not flagged in advance, or that do not fit safely in the vehicle, except where this would conflict with applicable law (for example, requirements relating to mobility equipment). If a Driver-Partner agrees to carry something that was not flagged at booking, an additional charge may apply.


11. Children and Unaccompanied Minors

If a child requires a car seat or booster, this must be specified at booking, including the child’s age and the type of restraint needed. A Driver-Partner may decline to transport an unaccompanied minor where local law restricts this or where we have not been given advance notice to arrange appropriate safeguards.


12. Conduct During the Ride

During every ride, you and any Guest must comply with applicable road traffic law, including wearing a seatbelt, and must follow the Driver-Partner’s reasonable safety instructions. Opening doors while the vehicle is moving, throwing objects from the vehicle, or behaving in a way that endangers the Driver-Partner or other road users is not permitted. Smoking is not permitted inside the vehicle; if you or a Guest smokes in the vehicle, you will be responsible for the cost of cleaning. Alcohol may only be consumed in the vehicle with the Driver-Partner’s prior agreement.

We may suspend or refuse service, without refund, where a rider’s or Guest’s conduct puts the Driver-Partner, other passengers, or the public at risk.


13. Cancellations, Rebooking, and No-Shows

You can cancel a booking through the App or website. Cancellations made at least 3 hours before the agreed pickup time are free of charge. Cancellations made less than 3 hours before the agreed pickup time are subject to a cancellation fee of 20% of the total cost of the ride.

Rebooking a ride is generally treated as a new booking; the cancellation terms above apply to the original booking accordingly.

A ride is treated as a no-show if you or your Guest do not appear at the agreed pickup location within 20 minutes of the agreed pickup time, unless you have contacted the Driver-Partner or Limpopo Ride to arrange a later pickup. A no-show is charged at 20% of the total cost of the trip.


14. Fares, Payment, and Invoicing

The fare shown at the time of Booking Confirmation reflects the vehicle class, route or hours booked, pickup location, and any special requests. Fares are processed through BudPay, our payment service provider, using the payment method you add to your account. By adding a payment method, you authorise us and BudPay to collect and store your payment information for this and future transactions, subject to our Privacy Policy.

Rides are generally invoiced per transaction rather than on a recurring basis. Corporate and partner accounts may be billed under separate terms agreed directly with that account.

If a payment fails, we may retry the charge, apply a reasonable processing fee for the failed attempt, and, where a payment method remains unresolved, suspend further bookings on the account until it is resolved.


15. Waiting Time and Additional Charges

A limited period of free waiting time is included at pickup for airport and standard rides, as shown in the App. Waiting time beyond that period is charged at the applicable per-minute rate for the booked vehicle class. Additional stops, extra distance, or extra hours are charged according to the rates displayed in the App at the time of the request, and may result in a total charge higher than the amount shown in the original Booking Confirmation.


16. Promo Codes and Vouchers

Promo codes and vouchers issued by Limpopo Ride are for individual use, cannot be combined with other offers unless we say otherwise, cannot be exchanged for cash, and may be subject to additional terms disclosed at the time they are issued.


17. Driver-Partners and Service Standards

Driver-Partners who provide rides through the App complete Limpopo Ride’s onboarding and orientation process before accepting bookings, and are expected to maintain our service, presentation, and conduct standards while providing a ride. 18. Regulatory Framework Governing the Service

Limpopo Ride operates within Nigeria’s regulatory framework for app-based transportation and consumer protection, including:

  • The Federal Competition and Consumer Protection Act, 2018, which gives the Federal Competition and Consumer Protection Commission (FCCPC) oversight of fair dealing, accurate pricing information, and consumer redress for services like ours.
  • Central Bank of Nigeria (CBN) regulations governing electronic payments, applicable to how fares are processed through BudPay.
  • The Nigeria Data Protection Act, 2023 (NDPA), which governs how we handle personal data; see our Privacy Policy for details.
  • The National Identity Management Commission (NIMC) Act, 2007, and applicable Federal Road Safety Corps (FRSC) requirements, relevant to how we verify a Driver-Partner’s identity and licence during onboarding.
  • Applicable Lagos State transport regulations governing app-based transportation operators, which govern our operating permits in the state.

If you have a consumer complaint that we have not resolved to your satisfaction, you may escalate it to the FCCPC.


19. Liability

19.1 What we’re responsible for. We are responsible for the operation of the App and website, the accuracy of your Booking Confirmation, and the correct processing of payment. We use reasonable care in selecting, onboarding, and monitoring our Driver-Partners.

19.2 What Driver-Partners are responsible for. Driver-Partners are responsible for the safe, lawful operation of the vehicle and compliance with applicable road traffic and transport law during a ride.

19.3 Limits on our liability. To the extent permitted by law, our liability for indirect or consequential loss arising from your use of the Service is excluded. Where loss arises from ordinary negligence, our liability is limited to loss that was a foreseeable result of the breach.

19.4 What is never limited. Nothing in these Terms limits our liability for death or personal injury caused by our negligence or that of a Driver-Partner acting within the scope of providing the ride, for our own gross negligence or willful misconduct, for fraud, or for any liability that cannot be excluded or limited under the Federal Competition and Consumer Protection Act, 2018, or other applicable Nigerian law.

19.5 Items left in the vehicle. We are not responsible for items left behind in a vehicle after a ride, though we will make reasonable efforts to help you reconnect with a Driver-Partner to recover them.


20. Availability of the App and Website

We aim to keep the App and website available and functioning correctly but do not guarantee uninterrupted or error-free operation. We are not liable for unavailability caused by matters outside our reasonable control, including failures of third-party networks, payment providers, or telecommunications services. We may update, suspend, or discontinue features of the App at any time for legitimate operational reasons; where this affects a booking you have already confirmed, we will contact you to arrange a fair resolution, such as a refund or rebooking, rather than simply leaving the booking unfulfilled.

We are not responsible for the content or availability of third-party websites linked from the App or website.


21. Account Suspension and Termination

We may suspend or terminate your access to the Service where we reasonably believe you have breached these Terms, provided false information, engaged in fraud or abuse, or put a Driver-Partner or other person at risk. Where practical, we will tell you why. You may close your account at any time by contacting us at info@limpoporide.com.


22. Intellectual Property

The Limpopo Ride name, logo, and the content and design of the App and website are protected by copyright and other intellectual property rights. We grant you a limited, revocable right to use the App and website for their intended purpose, conditional on your compliance with these Terms. Any other use, including copying, modifying, or redistributing App or website content, is not permitted without our written consent.


23. Privacy and Data Protection

Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms by reference. By using the Service, you acknowledge that your personal data will be processed as described there.


24. Force Majeure

We are not liable for a failure or delay in providing the Service caused by circumstances beyond our reasonable control, including strikes, civil unrest, severe weather, government action, or failures of public infrastructure.


25. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service or applicable law. Where a change materially affects your rights, we will give reasonable notice, such as an in-app notice or a “last updated” date at the top of this page, before it takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms.


26. Assignment, Set-Off, and Waiver

You may not assign your rights or obligations under these Terms to another person without our written consent. You may only set off against amounts you owe us, or withhold payment, where your counterclaim is undisputed or has been legally established. If we do not enforce a provision of these Terms on one occasion, that does not waive our right to enforce it later.


27. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Subject to your right to escalate a consumer complaint to the FCCPC as described in Section 18, the courts of Lagos State have jurisdiction over any dispute arising from these Terms or the Service.


28. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect, and we will work in good faith to replace the invalid provision with one that reflects its original intent as closely as possible.
